Service Level
Customer websites are hosted in a fully-redundant, state-of-the-art data center with a 99% average network uptime. We offer no Service Level guarantee or Service Level Agreement (SLA) given the possibility of external Internet connectivity issues beyond our control.

Website Content
The content of your website(s) is your property. Content is photos, descriptive text etc. provided by the customer for use on their website(s). Any unauthorized use of copyrighted materials is strictly prohibited. XsiteDesigns assumes no responsibility for the use of such materials. The layout of and any supporting scripts for your website(s) are either the property of XsiteDesigns or used under the GPL license and are non-transferrable. Scripts include but are not limited to those created and/or modified by XsiteDesigns.

All changes to your website(s) content are made by XsiteDesigns. We reserve the right to refuse any inappropriate content that is blatantly offensive or illegal.

Upon signing the XsiteDesigns Website Acceptance Form, requests from the customer referred to as "maintenance" are strictly limited to changes to text, photos or color scheme. All other requested changes will be considered "development" related and performed at an hourly or contracted rate.

Email

SPAM - Using your email account to send unsolicited, offensive, illegal or threatening material is strictly prohibited and may result in the immediate termination of your account. XsiteDesigns assumes no responsibility for the content of its customers' emails.

Viruses - Viruses delivered via email can be, and often are, harmful to your data. We strongly recommend that you have an up-to-date virus program AND DAT file in use on your PC and that you do not open email attachments unless you can positively confirm that the email and its attachment were intentionally sent to you. XsiteDesigns assumes no responsibility for damages resulting from viruses sent via email.

Security
You are responsible for any misuse of your account. XsiteDesigns assumes no responsibility for damages, perceived or real, resulting from the unauthorized use of your account.

Payments for Services
All payments to XsiteDesigns are final and non-refundable. However, in the unlikely event that XsiteDesigns no longer provides hosting services, you will be refunded the remaining balance of your annual hosting fee.

Acceptance of Terms of Service
By using our design and/or hosting services, you signify your agreement to our Terms of Service. We reserve the right, at our discretion, to change, modify, add or remove portions of this policy at any time. Please check this page periodically for any changes. Your continued use of our services following the posting of any such changes shall signify your acceptance of those changes.
